Mountain Coal Company Exhibit 69 <br /> West Elk Mine Sylvester Gulch Facilities <br /> level gate will normally be closed and will only be used to draw the Second Pond down when <br /> necessary for cleaning or other maintenance. The new discharge pipe will then continue <br /> approximately 170 feet from the weir/gate structure to a connection point to the existing outfall <br /> pipe at approximate El. 6800 ft MSL. <br /> As needed to maintain less than 2 feet of sediment in either pond, sediment or sludge that <br /> accumulates in the ponds will be removed by small equipment such as a Bobcat, mechanical <br /> dredging, or sludge pumps after pond dewatering. The material will either be disposed at an <br /> existing refuse pile at the West Elk Mine or disposed off site in accordance with applicable State <br /> and Federal laws. <br /> Storm Water Controls <br /> Site drainage will be consistent with drainage designs provided in PR07 and MR212, and as <br /> required by Rule 4.05.6. All storm water will either be contained within the ponds themselves, <br /> captured in existing road ditches DSLY-10 and 11 as shown on Map 54B, or covered tinder a <br /> Small Area Exemption(i.e. second pond outslopes). Calculations are included in Exhibit 66. <br /> The SGFA is also inspected on a semi-annual basis in accordance with the West Elk Mine Storm <br /> Water Management Plan. <br /> The disturbance area associated with the new pond construction will be less than 2 acres. Silt <br /> • fence will be installed below the pond and pipeline construction areas involving ground <br /> disturbance to control sediment in the event of precipitation during construction activity. <br /> CONSTRUCTION AND O&M PLANS <br /> Final Plans and Technical Specifications will be completed for the mine water treatment system. <br /> Construction Quality Assurance (CQA) will be performed during construction to verify that the <br /> constructed system complies with the design plans and specifications. CQA will also be <br /> performed to satisfy the inspection and certification requirements of Rules 4.05.9(14) and <br /> 4.05.9(15). An Operations and Maintenance (O&M) Plan will be developed prior to the <br /> completion of construction. Start-up testing for the new mine pump and pond treatment system <br /> will be completed after construction. The ponds will be inspected at least quarterly as required <br /> by Rule 4.05.9(17). <br /> RECLAMATION <br /> Maps 58B and 59B illustrate the reclamation plan for the SFGA, including the dewatering and <br /> treatment facilities. The areas will be returned to approximate original contours. The pond liners <br /> will be ripped, and concrete structures, side slope liners and embankment material will be <br /> placed/buried in the pond excavations. As necessary, additional fill from site stockpiles will be <br /> • used to establish the final grade. After regrading,topsoil will be spread, seeded, and mulched in <br /> 7 <br /> Rev.10/97-TR83,Rev. 04109-TR116 <br />
