Pineda <br />Director <br />RE: March 14-15, 2011 Complete Coal Inspection Follow-up <br />Foidel Creek Mine (Permit No. C-1982-056) <br />Dear Mr. Nettleton, <br />During a complete coal inspection conducted at the Foidel Creek Mine on March 14th and 15th, 2011 it <br />was observed that road grading conducted on a portion of Haul Road A resulted in material being <br />pushed and deposited into the south side road ditch and being heaped at the inlet of the Pond B light- <br />use road. This caused the run-off of Haul Road A and the sediment that was initially directed down the <br />south side of the intersection of the of the haul road and the light-use road into a sump, and proceed to <br />Pond B, being instead diverted in an unapproved manner through a berm on the north side of the light- <br />use road, then down the north side of the haul road/light-use road intersection. <br />The unapproved flow caused sediment to be deposited into Foidel Creek, at the inlet of the Foidel <br />Creek culverts under Haul Road A, rather than the approved sump. It was observed that there was <br />water in Foidel Creek, however the flow was minimal. <br />Through discussions with TCC personnel, TCC restored the Haul Road A ditch, reconstructed the <br />drainage path as required, removed material from Foidel Creek and re-stored the berm along the Pond <br />B light-use road before the end of the inspection. <br />Based on the inspection report, an internal review, and the mitigating circumstances, the Division has <br />determined that the situation does not appear to have left the permit area, does not seem to have caused <br />contamination beyond the immediate footprint of the deposited material, and due to the situation being <br />remedied immediately; a Notice of Violation (NOV) is not needed at this time. The situation has been <br />documented in the March 15, 2011 inspection report. <br />Please note that such circumstances must be avoided in the future to ensure compliance. If a constant <br />problem persists an NOV may be required.
