The 30 -inch diameter spillways of ponds 1 and 2 were partially reclaimed. The 90 degree bends <br />and attached skimmers were removed. A cap was placed on both ends of the two spillway pipes. <br />The upstream (inside the loop) spillway pipes were covered with the pond backfill material. The <br />two 30 -inch pipes were left in place with removable caps so they can be used in the future to <br />support the industrial land use. The pipes may be used in the future to bring utilities into the rail <br />loop or to pump water into or out of the rail loop. <br />Remaining coal and coal remnants over the entire rail loop disturbed area, including along <br />ditches, sediment pond inlet areas, the SAE bermed area along the toe of the rail outslope near <br />the loadout structure, and any other locations where coaly material had accumulated, was hauled <br />to the refuse disposal area. The concrete from footers and stemwalls was buried in place with a <br />minimum of 4 -feet of cover or hauled to an offsite disposal area. <br />The existing roads on site will remain in use and functional. Access road IA located at the South <br />Portal, constructed as part of the reclamation process, "borrowed" material from the UTL area. <br />The material came from the linear stacker embankment. <br />The alternative sedimentation control berm located northeast of the loop will be left in place <br />since the vegetation on the berm is established and the berm will continue to provide sediment <br />control for a portion of the track. <br />The old home site foundation, orchard remnants and the dense stand of 20 -30 foot high <br />cottonwood trees adjacent to the old home site located within the rail loop was protected during <br />the grading process and remains in place at the former UTL area. <br />PHASE II and III <br />SCC's Bond Release Application submitted July 6, 2010 was a full bond liability release request <br />of 75.2 acres at the former UTL Facility and Overland Conveyor areas. Reclamation obligations <br />have been entirely completed at these locations for which bond release was requested. <br />For Phase 11 bond release, Rule 3.03.1(2)(b) states, "Up to eighty -five percent of the applicable bond <br />amount shall be released upon the establishment of vegetation which supports the approved post <br />mining land use and which meets the approved success standard for cover... based on statistically <br />valid data collected during a single year of the liability period ". In regard to Phase 11 bond release, <br />Rule 3.03.2(3) (b) also states, " No more than sixty (60) percent of the bond shall be released so <br />long as the lands to which the release would be applicable are contributing suspended solids to <br />streamflow or runoff outside the permit area in excess of pre - mining levels as determined by <br />baseline data or in excess of levels determined on adjacent nonmined areas ". <br />However, Rules 3.03.1(2) (b) and 3.03.2(3) (b) are not applicable here because the approved post <br />mining land use of the bond release area is industrial/commercial. The appropriate revegetation <br />success criteria for the Unit Train Loadout, Permanent Flood Control Dike, Railroad Spur and <br />Overland Conveyor areas are given in Rule 4.15. 10 for areas to be developed for industrial use. <br />Page 7 <br />
