Summary and Conclusions <br />The Division has completed its review and evaluation of the Phase 1/11/111 bond release request <br />submitted by SCC for the Roadside Portals Mine, Unit Train Loadout and associated facilities, <br />Permanent Flood Control Dike, Railroad Spur and Overland Conveyor areas. Based upon a <br />review of the mine permit, the applicant's bond release application, and site inspections, the <br />Division finds that Snowcap Coal Company, Inc. has successfully completed all surface coal mining <br />reclamation operations at the UTL and Overland Conveyor areas in accordance with the approved <br />reclamation plan, and has met all requirements of the Act and Rules. The entire 75.2 acres for <br />which full bond liability release was requested is stable and in good condition. SCC has <br />successfully minimized disturbance to the prevailing hydrologic balance at the UTL and in <br />associated off -site areas. The quality and quantity of water in surface and ground water systems <br />has not been adversely affected. Pollution of surface or ground water is not occurring and is not <br />expected to occur. There were no signs of serious erosion or instability and the small non - active <br />use areas have been stabilized by seeding and mulching. The 75.2 acre reclaimed area will <br />support the approved post mine industrial /commercial land use and all reclamation obligations <br />have been completed within the bond release request area. <br />Based on the implementation of the industrial land use on the "active use areas" and further <br />based on the limited extent and stable condition of the small isolated "non- active use areas ", the <br />Division has waived the revegetation requirements of 4.15.10, pursuant to 4.15.10(3).Further, the <br />Division finds that all applicable criteria have been met for final bond release based on the full <br />implementation of the industrial/commercial land use as approved. <br />Page 15 <br />
