Piiieda <br />Director <br />RE: Preliminary Adequacy Issues for a 112d-1 Application, CN-01,, - <br />Wildcat Mining Corporation, May Day Idaho Mine Complex,'File No. M-1981-185-- <br />Dear Mr. Robinson: <br />Herein, all references to the Act and Rules refer to the Colorado Mined Land Reclamation Act, <br />34-32-101 et seq., C.R.S. (the Act or Hard Rock Act), and to the Mineral Rules and Regulations of <br />the Colorado Mined Land Reclamation Board for Hard Rock, Metal and Designated Mining <br />Operations (the Rules). The current Act and Rules are available on the Division's web site at <br />www.mining.state.co.us. <br />Through CN-01, Wildcat Mining Corporation (Applicant or Operator) attempts to comply with <br />the corrective actions of five violations and the conditions of a Mined Land Reclamation Board <br />approved Joint Stipulation, signed July 28, 2010 (Joint Stipulation). The application attempts to <br />address numerous issues including, but not limited to, the following: <br />• Geotechnical stability issues with the reconstruction and reclamation of an illegal access <br />road from County Road 124 to the bridge at La Plata River; <br />• Geotechnical stability issues with the reconstruction and reclamation of the illegal portal <br />at the May Day 1 level. The portal was constructed directly on a fault line. The portal <br />collapsed shortly after its unpermitted construction; <br />• Reconstruction of the illegal mill facility at the May Day 1 level and ultimate certification <br />of the facility as an Environmental Protection Facility. The unpermitted mill was <br />constructed directly on a fault line. The mill was not constructed to DMO standards. <br />The mill is now partially buried by debris from the collapsed illegal portal; <br />• Certification of an underground location as an appropriate Environmental Protection <br />Facility for the containment of mill tailings; <br />• Geotechnical stability issues for the access road to the Incas Mine, which was <br />undermined and possibly destabilized during the construction of the illegal Chief Portal; <br />• Reconstruction, possible relocation, and reclamation of the illegal Chief Portal, which <br />was located in the drainage channel of Little Deadwood Gulch; and <br />• Reconstruction of the drainage channel of Little Deadwood Gulch, which has been <br />adversely affected by mine activities at the Chief Portal and May Day 2 level. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
