Box 337 - _ - _ - ?- - _ _ -- <br />Henderson, CO 80604 <br />MAR -14 2011 <br />OFCO? <br />i \ 9 <br />O <br />1876 <br />Colorado Department <br />of Public Health ? <br />and Environment <br />Division of Reclamation, <br />Mining and Safety <br />RE: Conditional Approval of Amended Recycling and Reuse of Materials and Land Inert Filling <br />Notification dated February 14, 2011 <br />Dear Mr. Broda, <br />The Hazardous Materials Waste Management Division ("the Division") of the Colorado Department of <br />Public Health and Environment appreciates the opportunity to review the revisions made by Molen & <br />Associates to the Recycling and Reuse of Materials and Land Inert Filling Notification ("the <br />Notification") dated February 14, 2011. The amended notification is in response to the letter from the <br />Division dated February 1, 2011. <br />The Division conditionally approves of the Notification dated February 14, 2011 and considers the <br />placement of inert fill at the Aggregate Industries Platte Valley Pit Site to be a recycling activity <br />regulated by Section 8 of the Regulations Pertaining to Solid Waste Sites and Facilities 6 CCR 1007-2, <br />Part 1. However, the facility shall operate within the criteria described in the Notification to retain <br />status as a recycling facility. These processes include but are not limited to: proactive waste screening, <br />completing manifests signed by haulers for loads carrying materials from unknown locations, ground <br />water monitoring, placing asphalt and directional drilling fluids above the seasonally high groundwater <br />level, and maintaining volume and waste acceptance records for at least 3 years after filling at the site <br />ends. The types of material that may be accepted are inert brick, concrete, asphalt, soils free of <br />constituents exceeding the Colorado Soil Evaluation Values levels for unrestricted use, directional <br />drilling fluids, and masonry residuals. Cementatious materials, such as concrete and masonry residuals, <br />must be in a hardened state for at least sixty (60) days prior to placement in the fill area. <br />Broda shall submit the Recycling Facility Initial Registration form and subsequent annual Recycling <br />Facility Reporting forms which can be found online at: http://www.cdphe.state.co.us/hm/fonns.htm#sw. <br />The Platte Valley Pit will be considered a solid waste site and facility if groundwater monitoring detects <br />any negative impact that can be attributed to the inert fill operations. Therefore, the Division wants to <br />stress the importance of the waste screening plan-.
