1 0 (2)(a) (i) <br />Applicant - At this time no interest is expressed in this option. <br />The final reclamation plan is presented in Section 2.05.4 and further discussed in <br />Section 2.05.5. The final reclamation plan is designed to enhance habitat by <br />planting a grass dominated seedmix in order to balance grass forage production <br />against the shrub cover needs of wildlife. <br />Water depletions in the Upper Colorado River Basin have been recognized as a <br />major source of impact to endangered fish species ( USFWS 2/93). The applicant <br />has agreed to implement the conservation measures that the USFWS believes are <br />necessary to offset the water depletion impact. See Section 2.04.11 for a discussion <br />of the estimated water consumption (depletion) by the mine and Section 2.04.7(3) for <br />further discussion. <br />(2)(a)(ii) <br />The applicant believes it is practicable to show a trend toward enhancement of fish <br />and wildlife resources at the time revegetation has been successfully completed. <br />See sections 2.05.4, 2.05.5 and 2.05.6(2)(a)(i). Therefore, no further discussion is <br />required under this section. <br />(2)(a)(iii)(A - C) <br />A threatened and endangered species survey of the permit and adjacent area was <br />performed by Environmental Services, Inc. and Wildlife Habitat & Natural Resource <br />Specialists. No threatened and endangered species or significant habitat were <br />identified in the permit and adjacent area by either study. Rare Earth Science <br />prepared a threatened and endangered species study for the Bowie No. 1 mine <br />which is also applicable to the Bowie No. 2 Mine. The December 5, 2007 report <br />concludes the mining operation will have no effect on black- footed ferret, kit fox, <br />Uintah Basin hookless cactus, or clay - loving wild buckwheat and is not likely to <br />adversely affect bald eagle, western yellow - billed cuckoo, Canada lynx, northern <br />river otter, or boreal toad. Based on the water consumption the mining operation <br />may affect, and is likely to adversely affect bonytail, humpback chub, razorback <br />sucker, and Colorado pikeminnow, and their designated critical habitat. However, the <br />water depletion volume has been considered by formal Section 7 consultations. See <br />discussion in Section 2.04.11 and documents in Volume III, Exhibit 9. <br />Additional threatened and endangered species surveys will be undertaken prior to <br />additional surface disturbances as required by the respective surface management <br />agency. <br />The following control measures taken from the Final EIS dated February 2000 will <br />be undertaken by the applicant: <br />1. In order to minimize or prevent impacts to breeding species of raptors and <br />their fledglings the applicant will survey specific forest habitats prior to <br />construction for evidence of raptor nesting activity.
