MEMORANDUM TO FILE <br />Permit: M-1983-175 <br />Site name: Alamosa Pit #2 <br />Date: March 4, 2011 <br />Subject: Bond revisions <br />From: Bob Oswald, DRMS <br />The operator, Southwest Ready-Mix, Inc., had exposed groundwater and had accumulated sufficient debris onsite to <br />exceed the bond amount in 2008, which was $441, 623. <br />DRMS notified the operator about a bond increase, SI-3, and that the new estimated total was $4,531,149. The <br />figures were disputed by the operator and they requested more time, particularly to allow them to secure sufficient <br />water rights to allow exposed groundwater. DRMS granted the operator more time, but the bond increase was never <br />submitted, and the amount of bond posted remained $441,623. <br />In December 2010, DRMS inspected the site and met with the operator and consultant. The site was still under- <br />bonded and it was determined that no water rights were available. The operator was instructed to commence <br />backfilling and debris removal, and DRMS recalculated the bond amount and sent another notice of bond increase to <br />the operator. The new figures were discussed with the operator, and accounted for the new clean-up work being <br />performed in January and February, 2011. <br />The finalized new bond amount was $888,995, which did represent an increase of $447,372 above the existing bond. <br />That new bond amount was to be submitted by March 2011. However, since the previous bond recalculation (in <br />paragraph 2 above) which was a bond increase was "approved" though never submitted, the current increase in bond <br />had to be entered in the permit system as a reduction (from $4,531,149 to $888,995). The current change in the bond <br />amount is not entered as a bond increase, although in reality it is an increase. <br />The required bond amount ($888,995) is now posted, and the operator continues to backfill the ponds onsite and <br />remove debris from the site.
