The application proposes to leave eight livestock ponds in the mine <br />permit area as permanent features. The underground coal mining operation is located approximately 28 <br />miles south of Craig in Moffat and Route counties. <br />The eight livestock ponds referred to in this application are located in Sections 3 and 10 of <br />Township 3 North, Range 93 West, 6th PM. The applications have been approved as livestock water <br />tanks through the State Engineer's Office (SEO) and are on record under file nos. 18509-18516. These <br />tanks are exempt from the prior appropriation system as provided for in the Livestock Water Tank Act of <br />Colorado, CRS 35-49-101. So long as the applicant limits the use of these tanks to that provided for <br />under this act, the SEO has no objection to this application. <br />Thank you for the opportunity to comment on this project.
