support. Eackfilling or structural supports may be required to achieve long term
<br />support under the creeks and the structure upon retreat mining. The results of a •
<br />pillar stability analysis shall be used in the design and upon abandonment to
<br />determine the structural supports that may be required.
<br />(g) Transportation of Coal. The lessee will have thirty (30) months fx-om the
<br />date of lease issuance to obtain alternative means for transporting the coal from
<br />the mine to the rail loadout. After that date, no federal coal from the lease will
<br />be transported via truck on State Highway 233 with the exception of specialty coal
<br />and instances of force majeure. In cases of force majeure, the lessee must obtain
<br />approval of the authorized officer.
<br />(h) Deoasification Holes. Any surface disturbance related to installation of
<br />degasification boreholes, ventilation shafts, drill holes or any other
<br />surface-disturbing activity must be approved by the surface management agency. The
<br />lessee/cperator will be responsible for soil preservation/protection and final
<br />reclamation. For reclamation that would require reseeding, a certified wee3 free
<br />source cf seed would be used. The lessee will be responsible for controlling spread
<br />of, and eradicating noxious weeds.
<br />(i) U.S. Forest Service. (1) Controlled surface use is required for those areas
<br />having moderate geologic hazards and those areas with slopes of 40 to 605. A
<br />special interdisciplinary team analysis and mitigation plan detailing construction
<br />and mitigation techniques will be required on all or portions of Sec. 33, T. 12 S.,
<br />R. 91 W., 6th P.M, as described in Appendix I of the North Fork Coal Final EIS.
<br />() No surface occupancy or use is allowed on portions of Sec. 33 ancL 34,
<br />T.12 S., R.91 w., 6th P.M. which have high geologic hazards and areas with slopes
<br />greater than 605 as described in Appendix I of the North Fork Coal Final EIS.
<br />(:!) No surface occupancy or use will apply to all wetlands, floodplai.ns and
<br />riparian areas on the National Forest.
<br />(~k) Within the elk winter range in Sec. 33 and 34, T.12 S., R.91 W., 6th •
<br />P.M., no surface use is allowed from December 1 to April 30 for exploration,
<br />drilling and development activity. This stipulation does not apply to operation and
<br />maintenance of facilities associated with coal mining. Operation and maintenance of
<br />facilities associated with coal mining such as roads, waterlines, water tanks,
<br />powerlines, ventilation shafts, ancillary buildings, and including monitoring will
<br />be scheduled to minimize adverse effects on elk from December 1 to April 30.
<br />(:i) Within Sec. 33 and 34, T.12 S., R.91 W., 6th P.M., exploration drilling
<br />and development activity will not be allowed from October 1 through May 15, or
<br />whenever conditions in the spring are not sufficiently dry to allow operations
<br />without causing surface damage. Operations between October 1 and the Friday
<br />preceding regular big game hunting season, usually around October 19, may be allowed
<br />during dry weather upon written authorization of the authorized officer.
<br />(Ei) Within Sec. 33 and 34, T.12 S, R.91 W., 6th P.M., ne•~r roads on public
<br />lands will be closed year long to the public.
<br />~("') On the lands within Sec. 33 and 34, T.12 S., R.91 ri, 6th P.M., the
<br />operator will monitor for subsidence and mitigate adverse affects in accordance witix
<br />the USFS General Forest Stipulation. Measures will be taken to insure that the Dove
<br />Cave is protected from the negati•.re effects of subsidence and that its scrictura_
<br />integrity is maintained.
<br />(E!) Lands contained •Nith Sec 33 and 34, T. 12 S., R. 9": W., 6th P.M., are
<br />subject to the Forest Service Interim Rule, "administration o'_ the Forest Se rice

<br />12, 1999, pages 7290 through 7305. These lands will also be s-._bject to t::e final
<br />road management policy which wi_'_ be set within 1B months. `.o road construction
<br />will be allowed within the unroaded area until the Fores[ service adepts it= revise
<br />road management policy or 13 months frcm the effective dace of this fina'_ interim
<br />rule, whiche•rer is sooner.
