The holder shall contact the authorized officer at least two days prior to the anticipated start <br />of construction and/or any surface disturbing activities on theright-of-way. The authorized <br />officer may require and schedule a preconstruction conference with the holder prior to the <br />holder's commencing construction and/or surface disturbing activities. The holder and/or his .. <br />rcpteaentative shall attend this conference. The holder's contractor, or agents involved with <br />construction and/or any surface disturbing activities associated with the right-of--way, shall also <br />attend this conference to review the stipulations of the grand including the Plan of Development. <br />2. The holder shall construct, operate, end maintain the roadway within this right-of-way in <br />strict tonformity with the Plnn of Development (POD) which was filed on January 12, 2000, and <br />is mferenced herein and made a part hereof. Any relocation, additional construction, or use that <br />is sot in accord with the approved POD shall not be initiated without the prior written approval <br />of rho suthoriud officer. A copy of the complete right-of--way grant, including all stipulations <br />and the approved POD shall be made available oa the right-of--way during coastntction, <br />operation and maintenance of the roadway under this tight-of-way. Noncompliance with the <br />above will be grounds for an immediate temporary suspension of actividcs if it constitutor a <br />threat to public health and safety or the environment. <br />3. The holdor shall designate a teptesentative who shall have the authority to act upon and to <br />implement instructions from the authorized officer. The holder's representative shall be <br />available for communication with the authorized officer within a reasonable time when <br />construction or other surface disturbing activities are underway. <br />4. The authorized officer may suspend or urminate io whole, or in pact, any construction or <br />maintenance activities when in his judgement, unforeseen conditions arise which result in the <br />approved tt:rms and conditions being inadequate to protect the public health and snfcty ax to <br />protect the environment <br />5. The holder shall construct erosion control structures, such as water bars, culverts and any <br />othor preventative or restorative measure, as discussed in the field and requited by the authorized <br />offiur. <br />6. Road use will be restricted during inclement weather. During wet conditions, vehicles will be <br />restricted to 75016. GVW (ATV's). Wct condidons are defined as conditions when ruts greater <br />than two inches in depth are caused by a standard 3. ton pickup, or conditions where the road <br />surface is so slick that a vehicle cannot move under its own power. Dour assistance for <br />equipment movement on wet roads or blading of wet road surface to gain better traction will not <br />be allowed. <br />n <br />~J <br />
