Merrill <br />Western Water & Land, Inc. <br />743 Horizon Court, Suite 330 <br />Grand Junction, Colorado 81506 <br />RE: Gunnison River Gravel Pit Nos. 1 and 5, Substitute Water Supply Plan <br />DRMS File No. M-2009-048 <br />SE %, SE%, Section 28, T1 2S, R99W, and NE%, SE %, Section 33, T1 2S, R99W, 6th P.M. <br />Water Division 4, Water District 42, Mesa County <br />Approval Period: February 1, 2011 through January 31, 2013 <br />Dear Mr. Merrill: <br />We have reviewed your letter of July 7, 2009 and amendments dated February 3, 2010 and <br />November 18, 2010 requesting approval of a substitute water supply plan ("SWSP") for the Grand <br />Junction Pipe & Supply Company's ("Applicant" or "GJPS") Gunnison River Gravel Pit Nos. 1 & 5 <br />operation in accordance with § 37-90-137(11), C.R.S. The applicant shall be responsible for <br />compliance with this plan, but the State Engineer's Office ("SEO") may also pursue the landowner <br />for eventual compliance. The required fee of $1,593 has been received (receipt no. 3641560). <br />SWSP Operations <br />The Gunnison River Gravel Pit Nos. 1 & 5 operation is proposed to consist of five gravel pits <br />that are all located within one contiguous mine area that is permitted under Reclamation Permit No. <br />M-2009-048. Pit Nos. 2, 3, and 4 will be developed in the future and only Pit Nos. 1 and 5 are <br />included in this approval. Pit Nos. 1 and 5 are located adjacent to the west bank of the Gunnison <br />River as shown on the attached Figure 1. Pit No. 1 is located in the SE % of the SE % of Section <br />28, T 12 S, R 99 W and Pit No. 5 is located in the NE % of the SE % of Section 33, T 12 S, R 99 W. <br />The anticipated mine life for Pit No. 1 is three years assuming an operating period of 3 <br />months per year and 22 days of operation per month. The anticipated mine life for Pit No. 5 is also <br />three years assuming an operating period of 10 months per year (typically January through June <br />and September through December) and 22 days of operation per month. During the years of <br />operation, it is anticipated that up to 70,000 tons of material per year will be mined at Pit No. 1 and <br />up to 250,000 tons of material per year will be mined at Pit No. 5. <br />At the completion of mining, Pit Nos. 1 and 5 are proposed to be reclaimed as unlined <br />ponds with up to 3.6 acres of ground water exposed in Pit No. 1 and up to 6.8 acres of ground <br />water exposed in Pit No. 5. Both pits will be dewatered during pit operations. At Pit No. 1, <br />dewatering is proposed to be performed from June through August and Pit No. 5, dewatering is <br />proposed to continue throughout the life of the mining operation.
