s <br />Section 2.05.4 of the permit application describes the reclamation plan for the SL-04 bond <br />release area. The structures approved for permanent retention in the SL-04 bond release area are: <br />the main asphalt-surfaced haul road, the culverts underneath that road, the North Pit haul road, <br />and topsoil stockpiles 4 and 7. <br />Submittal of Bond Release Application and <br />Completeness Determination by the Division <br />The Division received Oakridge's bond release application SL-04 on July 30, 2008 and found the <br />application incomplete on September 26, 2008. The Division notified Oakridge in a letter dated <br />September 26, 2008 that two items were needed to make the application complete: the notarized <br />statement required by Rule 3.03.2(1)(e) regarding completion of reclamation, and information <br />regarding achievement of the postmining land use. The Division found the application complete on <br />October 10, 2008 after receiving the requested notarized statement and post-mining land use <br />information. The Division had also received the proof of publication of the applicant's public notice. <br />The completeness determination was made in accordance with Section 3.03.2(1)(d). <br />Oakridge submitted the bond release application following the procedures described in the Act and <br />the Regulations. The application also utilizes the Division's Guideline Regarding Selected Coal <br />Mine Bond Release Issues, dated April 18, 1995. <br />Public Notice <br />Oakridge published notice of the bond release application in the Durango Herald once weekly for <br />four consecutive weeks, beginning on August 8, 2008.Oakridge also notified landowners within and <br />adjacent to the mine permit area and other interested parties of the application for bond release, as <br />required by Section 3.03.2(1). The Division received no written objections or requests for an <br />informal conference regarding the bond release application. <br />Bond Release Inspection <br />The Division conducted a bond release inspection on October 29, 2008. The site inspection was <br />conducted in accordance with Section 3.03.2(2). Tom Kaldenbach represented the Division. <br />Michael S. Savage, of Savage and Savage Environmental, represented the operator, and Henry <br />Austin represented the Office of Surface Mining. Oakridge owns all of the land surface in the bond <br />release area. The Division's inspection report is on file at the Division's Denver office. The <br />inspection was conducted in accordance with Section 3.03.2(2). The inspection focused on the <br />following topics: completion of backfilling, grading, drainage re-establishment, erosional stability, <br />slope stability, revegetation, reclamation success, and implementation of the approved postmining <br />land uses. <br />Technical Review <br />The review of the SL-04 application considered the requirements of Oakridge's approved <br />reclamation plan and the regulatory requirements for bond release.
