also include a description of any appearances of instability, structural weakness, or other hazardous <br />conditions observed during the inspection. MCC will retain a copy of the report at the West Elk <br />Mine offices. <br />Reports addressing the underdrain system and protective filters will include color photographs taken <br />during and after construction, but before underdrains are covered with excess spoil. Since <br />construction of a new phase of underdrain system is planned every one to two years, each <br />construction phase will be certified separately. The color photographs accompanying each certified <br />report will be taken in adequate size and number with enough terrain or other physical features of the <br />site shown to provide a relative scale to the photographs and to specifically and clearly identify the <br />site. <br />4.8.2 Routine Quarterly Refuse Pile Inspections <br />The refuse pile will be inspected quarterly by a by a qualified registered engineer, or other qualified <br />professional specialist under the direction of the professional engineer, experienced in construction <br />of similar earth and waste structures, approved by the Division. Inspections will be conducted <br />quarterly, beginning within seven days after completion of refuse pile area preparation construction. <br />Inspections will continue until the refuse pile has been graded, covered in accordance with 4.10.4(4), <br />topsoil has been distributed, and the area revegetated in accordance with the reclamation plan <br />(Section 8). <br />Inspections will include observation of seepage rates, review of slopes for indications of movement, <br />and such observations and tests as may be necessary to evaluate the potential hazard to human life <br />and property. Inspections will include review of preparation of new refuse pile development areas to <br />ensure that all colluvium, organic material, and topsoil have been removed and that proper <br />construction and maintenance are occurring in accordance with the intent of the design presented in <br />this TR 120. Copies of inspection reports will be maintained in West Elk Mine offices. <br />If any inspection discloses that a potential hazard exists, the Division will be promptly informed of <br />the finding and of the emergency procedures formulated for public protection and remedial action.
