i?
I
Mr. Dick Wolfe
March 1, 2011
Page 3
acre-feet per share based on the quantification provided in the decree in Case No. 05CW076) is
38.7 acre-feet per year, and is shown in detail in Table 2. Table 3 shows the net
accretion/depletion calculation for the 2011 plan year.
Replacement deliveries will be made in the manner described in the, decree for Case No.
05CW076. Specifically, 10 percent of the prorata ditch diversion for 6.1 shares will be diverted
in the Larkin Ditch to replace ditch losses. The remaining 90 percent of the prorata diversions
for the subject shares will be measured and returned to the Colorado River at or near the ditch
headgate.
POST PLANDEPLETIONS
Reclamation of the mining area is expected to result in up to 11.6 acres of exposed water
surface area with a net depletion of 27.62 acre-feet during the April through October call
period. Post plan depletions will be covered by the dedication of at least 6.1 Larkin Ditch
shares which generate 41.9 acre-feet of historical consumptive use credit to an augmentation
plan expected to be modeled on the augmentation plan decreed in Case No. 05CW076. The
expected post plan depletions and replacements for May 2012 through April 2013 are shown
in Table 4.
The volume of water required to fill the pit after mining has been completed will either be
supplied through a lease during the call period, or the pit will be continuously dewatered until
such time as the pit can be filled by groundwater infiltration or delivery from the Colorado
River via the Larkin Ditch during a free river period. Prior to filling the pit, the amount of
water required will be calculated, and the Water Commissioner and Division Engineer will be
notified of the proposed plan.
CONCLUSION
This amendment provides an evaluation of the stream depletions expected as a result of
Kirkland's operation of the Debeque Pit for commercial purposes, and presents a means by
which the stream depletions occurring during the April-October call period will be replaced in
order to prevent injury to other water rights on the Colorado River.
