<br />DEERE & AULT <br />CONSULTANTS, INC. <br />00 <br />014 <br />sob <br />A <br />March 1, 2011 <br />Mr. Dick Wolfe <br />State Engineer <br />Colorado Division of Water Resources <br />1313 Sherman Street, Suite 818 <br />Denver, Colorado 80203 <br />Re: Debeque Gravel Pit 2011 Substitute Water Supply Plan Renewal Application <br />(DRMS Permit No. M-81-058) <br />Dear Mr. Wolfe: <br />This letter presents an application to renew a temporary substitute water supply plan (SWSP) <br />to replace depletions from operations at Kirkland Construction, RLLP's (Kirkland's) Debeque <br />Pit gravel mining operation. The SWSP renewal will be for the 2011 plan year, May 1, 2011 <br />through April 30, 2012. Enclosed is a check for $257 to cover the fee for this renewal. <br />INTRODUCTION <br />The Debeque Gravel Pit is located in the southeast quarter of Section 8 and southwest quarter of <br />Section 9, T9S, R97W, of the 6a` P.M. in Mesa County, Colorado. The DMG permit at this site <br />is still active and valid, and all proposed mining will occur within the boundaries of the <br />permitted area. Depletions to the Colorado River will result from water loss in the mined <br />product, dust control, and evaporation from exposed water surfaces. <br />After mining operations are completed, the site will be reclaimed as an unlined pond with a <br />surface area of no more than 11.6 acres. The existing 3.6 acre pond will be contiguous with the <br />added pond area. Long-term evaporation replacement will be by a plan for augmentation <br />modeled on an existing plan already decreed for replacement from the 3.6 acre pond. <br />An Underground Water Right, Change of Water Rights, and a Plan for Augmentation were <br />decreed in Case No. 05CW076 which provides for augmentation of 3.6 acres of exposed <br />groundwater surface. A copy of the decree in that case is included in Appendix A. The decree <br />describes post-mining augmentation at the Debeque Pit, and includes a quantification of <br />evaporative losses due to the existing 3.6 acre exposed groundwater pond, parameters to be used <br />in groundwater lagging calculations at this site, quantification of historical phreatophyte <br />consumptive use credit at this site, and a quantification of historical consumptive use associated <br />with the Lathams' 20.5 shares of Larkin Irrigation Company stock. Whenever possible, this <br />renewal will defer to the calculations and quantities described in the decree. <br />600 S.
