Cess LEGAL NOTICES PUBLIC NOTICE New Elk Coal Company LLC, 122 West First St, Trinidad CO 81082, the operator of the New Elk Mine, Permit num- ber C-81-012 has filed a complete application for a techni- cal revision to the New Elk Permit with the State of Colo- rado Division of Reclamation Mining and Safety. Permit C-81-012 renewal was approved by the Division on April 13, 2009. For filing purposes this technical revision appli- cation was deemed complete by the Division on March 1, 2011. The New Elk Mine is located approximately 7 miles west of Weston, Colorado on State Hwy 12 within Sections 13, 14, 21, 22, 23, 24, 25, 28, 27, and 28 TS33S, R68W. These sections can be located on the USGS 57 minute Vigil and Weston quadrangle maps. The Jansen. Loadout is R64W if tge 6th dP>M> in Las SAnimas County. The specific legal description of the lands included within the permit area is a metes-and-bounds description, which is included in Exhibit 40 of the perit application. The area described for rthe Ioadout is shown on the USGS 7.5 min- ute Quadrangle map of Trinidad West. A total of 207.5 acres of surface disturbance from mining related activity is covered by a Letter of Credit Bond and Cash Bond in the amount of $3,474,226. The Technical revision provides for an incidental permit boundry expansion of 22.5 acres. included in the coal lease within the of the Bosque del Oso. The revision also includes development mining of the Allen seam north and east of the slopes in the existing permit area and mining the Apache seam south and east of the slopes in the ex- pansion area. Where the Apache seam is not situated over old Allen seam works, secondary mining by pillar re- covery is proposed. The mining area underlies a portion of the Bosque del Oso State Wildlife area which was transferred to the state by previous mine owners. New Elk Coal Company, LLC as the right to mine in this area as governed by a lease agreement. No increase in surface disturbance is planned. The technical revision is on file for public inspection at the Las Animas County Courthouse Office of County Re- corder and at the offices of the Division of Reclamation, Mining & Safety, 1313 Sherman St., Room 215, Denver, CO, 80203, (303) 866-3567.
