Cess <br />LEGAL NOTICES <br />PUBLIC NOTICE <br />New Elk Coal Company LLC, 122 West First St, Trinidad <br />CO 81082, the operator of the New Elk Mine, Permit num- <br />ber C-81-012 has filed a complete application for a techni- <br />cal revision to the New Elk Permit with the State of Colo- <br />rado Division of Reclamation Mining and Safety. Permit <br />C-81-012 renewal was approved by the Division on April <br />13, 2009. For filing purposes this technical revision appli- <br />cation was deemed complete by the Division on March 1, <br />2011. <br />The New Elk Mine is located approximately 7 miles west <br />of Weston, Colorado on State Hwy 12 within Sections 13, <br />14, 21, 22, 23, 24, 25, 28, 27, and 28 TS33S, R68W. <br />These sections can be located on the USGS 57 minute <br />Vigil and Weston quadrangle maps. The Jansen. Loadout <br />is R64W if tge 6th dP>M> in Las SAnimas County. The <br />specific legal description of the lands included within the <br />permit area is a metes-and-bounds description, which is <br />included in Exhibit 40 of the perit application. The area <br />described for rthe Ioadout is shown on the USGS 7.5 min- <br />ute Quadrangle map of Trinidad West. <br />A total of 207.5 acres of surface disturbance from mining <br />related activity is covered by a Letter of Credit Bond and <br />Cash Bond in the amount of $3,474,226. <br />The Technical revision provides for an incidental permit <br />boundry expansion of 22.5 acres. included in the coal <br />lease within the of the Bosque del Oso. The revision also <br />includes development mining of the Allen seam north and <br />east of the slopes in the existing permit area and mining <br />the Apache seam south and east of the slopes in the ex- <br />pansion area. Where the Apache seam is not situated <br />over old Allen seam works, secondary mining by pillar re- <br />covery is proposed. The mining area underlies a portion <br />of the Bosque del Oso State Wildlife area which was <br />transferred to the state by previous mine owners. New Elk <br />Coal Company, LLC as the right to mine in this area as <br />governed by a lease agreement. No increase in surface <br />disturbance is planned. <br />The technical revision is on file for public inspection at the <br />Las Animas County Courthouse Office of County Re- <br />corder and at the offices of the Division of Reclamation, <br />Mining & Safety, 1313 Sherman St., Room 215, Denver, <br />CO, 80203, (303) 866-3567. Written comments regarding <br />this application may be submitted to and additional infor- <br />mation may be obtained from the Division of Reclamation, <br />Mining & Safety at the above address.
