Pineda <br />Director <br />Re: Broyles Pit, File No. M-2004-028; Receipt of an Incomplete 112 Construction Materials Reclamation Permit <br />Conversion Application Package <br />Dear Mr. Febbraro, <br />On February 25, 2011 the Division of Reclamation, Mining and Safety received your 112 Construction Materials <br />Reclamation Permit Amendment Application package for the Broyles Pit, File No. M-2004-028. You are requesting to <br />add additional acreage to the permit area. Given the number of acres you must add, this application must be <br />submitted as a Conversion instead of an Amendment. <br />In accordance with Rule 1.11.2 the applicant of a conversion application must submit all the information required by <br />the act and the Rules for the size of the operation. However, you need not supply any information required which <br />has been previously supplied unless such information is different from that in the original application. For each of <br />the exhibits described below, you must either indicate where in the original application or supporting documents the <br />information not included in the new exhibit can be found; or, you must supply the information required for the <br />exhibit. Given this, the preliminary review of the information received determined that the following items must be <br />received before the Division can consider your application as being submitted and technical review can begin: <br />APPLICATION FEE: <br />1. The application was submitted as an Amendment; however this type of modification of the permit area is <br />required to be processed as a Conversion. The fee submitted for the application was $2,229.00. The fee <br />necessary for a conversion is $2,696.00. Please submit an addition $467.00 for the application fee. <br />APPLICATION FORM: <br />2. The submitted application was missing Pages 5 and 6, please submit these pages completed with the <br />necessary initials. I have enclosed a copy of these pages. <br />EXHIBIT A Legal Description (Rule 6.4.1): <br />3. The legal description must identify the affected land and be wholly adequate for field location of the <br />property. It can be in the form of metes and bounds survey or a description by reference to township, range <br />and section to at least the nearest quarter quarter section.
