Engineers, and as well to comply with appropriate zoning, land use and other ordinances and <br />regulations of Routt County. <br />b. To conduct all operations in accordance with the laws of the United States and the <br />State of Colorado, including, without limitation, the water laws, mining laws and regulations of <br />the State Engineer. <br />C. To allow the Lessor or his agents, from time to time, to enter upon all parts of the <br />leased premises for the purpose of inspection, surveys, taking of samples and measurements. <br />d. To provide the Lessor continued access to those portions of the leased premises not <br />actually being used in mining activities of the Lessee to the extent that Lessor has surface rights <br />and to accept the leased premises in its present condition. <br />e. To keep the leased premises at all times clear of trash, rubbish, or junk, unless <br />prevented by extraordinary conditions or temporary breakdown of equipment and to keep the <br />access to the leased premises locked at all times when operations are not being conducted. <br />f. To conduct a gravel operation and related activities and for no questionable or <br />improper purpose whatsoever. <br />g. To provide the Lessor, during the term of this lease, certificates of insurance <br />showing that the Lessee has in full force and effect public liability and property damage <br />insurance with an insurance company acceptable to Lessor in the amount of $1,000,000. <br />h. At the termination of the lease, to leave the leased property in an orderly and clean <br />condition conforming to the requirements of the reclamation plan shown in the Colorado <br />Division of Minerals and Geology "mining permit" when it is obtained. <br />i. To pay all personal property taxes on the personal property of the Lessee in and about <br />the leased premises, and also to be responsible for payment of all other taxes related to Lessee's <br />operation including but not limited to sales taxes. <br />j. Not to cause or suffer to allow any lien, judgment, levy or attachment to be placed <br />upon the property of the Lessor by reason of any actions of the Lessee of any nature or kind. <br />k. To utilize the leased premises as the Lessee's only source of gravel for its operations <br />within a radius of twenty miles of Hayden, Colorado. <br />1. To submit monthly reports showing the quantity of materials removed; to keep strict <br />and accurate records of materials removed; and to permit Lessor to examine mining procedures <br />and check books and records, as provided in Paragraph 2 hereof. <br />4.
