PERMIT #: M-1979-111 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: February 18, 2011 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Jeff Tatkenhorst and Bob Johnson of the Colorado Department of Transportation were also present <br />for the inspection. The Enderson Pit is located approximately 13 miles north of Arriba, Colorado. The site is <br />permitted for 6.3 acres and is situated on the Arickaree River. <br />Mining operations at the Enderson Pit have ceased; no mining equipment is present. The permit sign was <br />missing from the site entrance; this has been cited as a problem and will require corrective action by the <br />Operator. In addition, the permit boundary was not delineated by monuments or markers; this has been cited <br />as a problem and will require corrective action by the Operator. Mining at the Enderson Pit took place in the <br />channel of the Arickaree River. The area on the north bank of the Arickaree River was used as a staging area; <br />there is currently a small sand stockpile located in this area that was recently pushed from the channel of the <br />river. Another stockpile is located on the south bank of the river; the stockpile is approximately, 6' tall, 10' <br />wide and 150' in length; the landowner would like this material to remain in place so they may use it in the <br />future. The approved Reclamation Plan does not allow for the stockpile to remain in place. In order for the <br />stockpile to remain, the Operator shall revise the Reclamation Plan to account for the presence of the <br />stockpile by submitting a Technical Revision. In addition, the Operator shall demonstrate the landowner's <br />approval of the revision by submitting a signed and notarized statement from the landowner. <br />The following reclamation tasks must be completed before the site is eligible for release: <br />1) Remove the product stockpile from the north bank of the Arickaree River. <br />2) Grade the north bank of the Arickaree River to 2H:1V. <br />3) Scarify the staging area north of the Arickaree River. <br />4) Drill seed the staging area and the haul road with the approved seed mix. <br />Once all reclamation has been completed at the site the Operator may request a release by submitting a <br />written notice of completion of reclamation in accordance with Rule 4.17.1: <br />1) The operator shall include in the notice to the Office the names and addresses and phone numbers of all <br />owners of record to the affected land. <br />2) The written notice requesting release shall be sent by Certified Mail and be separate from other types of <br />communication to the Office. <br />3) Such notice shall contain a signed statement by the Operator or their agent that all applicable portions of <br />the Reclamation Plan requirements have been satisfied in accordance with the Rules and all applicable <br />requirements under the Act. <br />This concluded the inspection. <br />Page 2 of 4
