Pineda <br />Director <br />Hayden, CO <br />81639 <br />Re: Frentress Gravel Pit, File No. M-2011-017, Receipt of Construction Material Limited Impact (110) Reclamation <br />Permit Application Package <br />Dear Mr. Domson: <br />On Wednesday, March 02, 2011, the Division of Reclamation, Mining and Safety received the Construction Material Limited <br />Impact (110) Reclamation Permit Application package for the Frentress Gravel Pit, File No. M-2011-017. A preliminary <br />review of the information received determined that the following items must be corrected/received before the Division <br />can consider the application submitted and technical review can begin: <br />APPLICATION FORM: <br />Item 1 on the application form must list the exact name registered with the Colorado Secretary of State's office if the <br />applicant is a company (i.e. Breeze Basin Resources Inc.). <br />Revise the signature page (page 7) so that the company name listed exactly matches the name registered with the <br />Colorado Secretary of State's office (see enclosed sample signature page). <br />Per Rule <br />6.3.7 EXHIBIT G - Source of Legal Right-to-Enter <br />Provide a description of the basis for legal right of entry to the site and to conduct mining and reclamation, for Owners <br />of Record described in Rule 1.6.2(1)(e)(i). This may be a copy of access lease, deed, abstract of title, or a current tax <br />receipt. A signed statement by the Landowner and acknowledged by a Notary Public stating that the <br />Operator/Applicant has legal right to enter and mine is also acceptable. <br />Note: the warranty deed provided as Exhibit G with the application package does not contain the NW M NE % or the NE <br />'4 NW'4 of Section 13, Township 6 North, Range 89 West of the 6 `h p. M.
