February 28, 2011 <br />Colorado Division of Reclamation, Mining and Safety <br />1313 Sherman St., Rm. 215 <br />Denver, CO 80203 <br />RAR <br />2 2®,' <br />?ivis o ngo P. <br />Mid ng aka Sa?ai ce <br />ety <br />RE: Wildcat Mining Corporation 112-d Permit Application for May Day Idaho Mine Complex <br />CDRMS file number M-1981-185 <br />Dear DRMS, <br />As residents of La Plata Canyon and a near neighbor to the operations of the Mayday Mine, we <br />have many concerns. <br />Will the use of the unapproved access road that looms over the La Plata River as identified in the <br />reports provided by Wallace Erickson dated 12/17/09, 4/19/10 and 4/22/10 be deemed a legal access to <br />the mining operations without further engineered improvements or has Wildcat Mining Corporation <br />(WMC) been granted other legitimate access? <br />a <br />According to Colorado Division of Minerals & Geology Report dated 2/28/11, there are 7 other <br />gold and/or Silver mines listed in La Plata County with currently four, including one of the Mayday Mine <br />permits, indicating their status as active. A concern for the citizens that enjoy La Plata canyon is that <br />further approval of activity by WMC may precipitate the inclusion of ore being processed from those <br />other mines in La Plata County at the Mayday/Idaho mill location. With consideration to a <br />proportionate increase in size of operations to handle more ore, besides requiring a greater fee for <br />surety, is approval of increased activity to any such magnitude a possibility in the eyes of the DRMS? <br />Section 3.3.1 (4) of the Mineral Rules and Regulations states: "Any Operator eligible for, but <br />operating without a permit under Section 34-32-110, C R.5 et seq., 1984, as amended, and any Prospector who <br />operates without filing a Notice of intent, shall be subject to a Civil Penalty of not less than fifty dollars ($50.00), <br />nor more than two hundred dollars ($200.00) er da for each day the land has been affected. Such penalties shall <br />be assessed for not less than one day and not more than sixty (60) days." Has WMC been charged with these <br />fines for installing the unpermitted mill facility in an unpermitted portal or for any of the past activity? <br />Different management, same company.
