(permit # M-1981-185) unacceptable. <br />The applicants prior history of numerous illegal activities regarding the division's rules and <br />regulations should disqualify them from consideration of this permit. <br /> <br />We question their access road (built substandard and unpermitted) which is less than 100 feet <br />from a number of very shallow wells (less than 20 feet). Their hauling of toxic chemicals and <br />fuel adjacent to our property lines and wells presents an unacceptable risk. The traffic on this <br />road may increase compaction of the roadbed and thus water infiltration and recharge to our <br />wells, it may also impact water quality. I have needed to have water trucked to my cistern this <br />winter for the first time since our system was completed. My conjecture is that through their <br />illegal traffic across the river in the last few years with heavy equipment or an intentional <br />smoothing .of the river crossing, has diverted the flow of the La Plata River away from the west <br />channel to it all flowing in the east channel, which has impacted the groundwater recharge of <br />my well. Where recharge was not an issue in the decades past, this is a logical cause. We have <br />heard Arron Taylor has been hauling water for two years due to the same circumstances. The <br />mine's proposed operations and tailings pile's proximity to the La Plata River and our wells is <br />highly risky. <br />We question the permit application's disposal of tailings in the old mine workings. Due to the <br />highly faulted and fractured nature of the permit area their suppossition that ground and <br />surface water would not be affected is highly doubtful.
