<br />design specifications, construction specifications, maintenance schedules, criteria for inspection, as well as expected
<br />performance and longevity of the best management practices. Using watershed models, the operator must demonstrate
<br />that implementation of the Sediment Control Plan will result in average annual sediment yields that will not be greater
<br />than the sediment yield levels from pre-mined, undisturbed conditions. The operator must use the same watershed model
<br />that was, or will be, used to acquire the SMCRA permit. The operator must design, implement, and maintain BMPs in
<br />the manner specified in the Sediment Control Plan.
<br />The permittee is required to submit the Sediment Control Plan for approval, for Outfalls 009A and 015A, including
<br />documentation of the sediment yield from pre-mining, undisturbed conditions by December 1, 2007.
<br />b. Materials Containment Plan - The permittee has previously submitted an engineered spill plan. An update to the plan
<br />is required to be filed by February 1, 2007, detailing all changes that have occurred since the original submittal. If no
<br />changes have occurred, a letter to this effect is required. For specific requirements, refer to Part I.D.1. of the permit.
<br />c. Total Recoverable Iron Final Limitations for Outfalls 005, 006.010.011 and 016: The compliance schedule for total
<br />recoverable iron is granted for the permittee to present information to the Water Quality Control Commission (WQCC)
<br />on the ambient water quality of the receiving streams, in the attempt to obtain a site-specific standard or temporary
<br />modification, based upon the 85 h percentile of the ambient water quality data being higher than the standard.
<br />i. The permittee must, by December 31, 2007, submit a progress report summarizing the efforts undertaken by the
<br />permittee for a site specific limitation for total recoverable iron, in regards to the WQCC hearing for the Upper
<br />Colorado River Basin.
<br />ii. The permittee must, by December 31, 2008, submit a progress report summarizing the efforts undertaken by the
<br />permittee for a site specific limitation for total recoverable iron, in regards to the WQCC hearing for the Upper
<br />Colorado River Basin, as well as the WQCC decision from the rulemaking hearing in June 2008.
<br />iii. The permittee must, by September 30, 2008, s Submit to the Division an amendment request for either updating the
<br />limitation for total recoverable iron based upon a site specific standard (if approved by the WQCC), or for additional
<br />time to meet the limitation which currently takes effect on January 1, 2009.
<br />d. Activities to meet the Selenium Final Limits at Outfalls 008.012, 012,016 and 017- The compliance schedule for
<br />selenium grants the permittee time to meet the selenium limitation.
<br />i. The permittee must submit a report documenting the actions taken to meet the permit limitations by December 31,
<br />2010.
<br />ii. The permittee must submit a report documenting the actions taken to meet the permit limitations by December 31,
<br />2011.
<br />iii. The permittee must submit a report documenting the actions taken to meet the permit limitations by December 31,
<br />2012.
<br />iv. The permittee must submit a report documenting the actions taken to meet the permit limitations by December 31,
<br />2013.
<br />V. The permittee must submit a report documenting the actions taken to meet the permit limitations by December 31,
<br />2014.
<br />vi. The permittee must submit documentation that the limitation will be met by December 31, 2015.
<br />Upon approval of the implementation plan by the Division, all terms and conditions of the implementation plan, including
<br />but not limited to the compliance schedule, will automatically become conditions of this permit.
<br />6. Chronic WET Testing-Mutfall WTE)
<br />a. Testing and Reporting Requirements
<br />Tests shall be done at the frequency listed in Part I.B. I. Test results shall be reported on the Discharge Monitoring
<br />Report (DMR) submitted for the reporting period during which the sample was taken. (i.e., WET testing results for the
<br />first calendar quarter ending March 31 shall be reported with the DMR due April 28.) The results shall be submitted on
