INTRODUCTION <br />Ms The active Seneca II Mine Permit (State Permit No. C-005-80, Federal Permit No. CO- <br />006) was originally submitted to the Division on December 30, 1980 under Colorado's <br />Permanent Regulatory Program and was subsequently approved on September 23, 1981. <br />Five five-year renewals have been issued since Permit C-80-005 was originally approved; <br />the first on February 17, 1987, the second on February 17, 1992, the third on July 25, <br />1997, the fourth on February 17, 2002, and current permit term was approved on February <br />17, 2007 and extends until February 2012. <br />SCC proposes to reduce the size of the original Seneca II permit area to accommodate the <br />new Peabody Sage Creek Mine (PSCM) permit area. The PSCM permit area will include <br />approximately 3,011.9 acres of the original Seneca II permit area. The revised Seneca II <br />permit area will retain 386.5 acres of the original permit area that includes 271.0 disturbed <br />acres. This new Seneca II Mine permit boundary encompasses one isolated watershed and <br />separates runoff from the Seneca II Mine and the new PSCM permit area. The watershed <br />discharges to Pond 008, which is an approved NPDES discharge point. SCC proposes to <br />revise only applicable sections and maps of the original Seneca II PAP to reflect current <br />and future conditions. The currently approved Seneca 11 PAP will be left intact to provide <br />baseline information and background operational information. The new revised permit <br />area is shown on Map 2.05-M1, Postmining Topography and Permanent Features. <br />There will be a reduction in the amount of reclamation liability for the new Seneca II <br />permit area. In the interim, SCC will continue to hold the full reclamation bond (based on <br />SL04 bond calculation) of $3,973,637 on the entire Seneca II permit area until PSCM <br />receives permit approval and submits a reclamation bond for their new permit area (which <br />includes 3,011.9 acres of the original Seneca II permit area). <br />Now that the new Seneca II permit area has been reclaimed and has received Phase I bond <br />release and partial Phase II bond release, SCC will revise only applicable sections of the <br />original PAP to reflect current and future conditions, these sections are provided in this <br />Permit Application Package and are titled: <br />• Introduction <br />• Rule 2.03.4 - Legal, Financial, Compliance and Related Information <br />• Rule 2.04.7 - Hydrology Description and Monitoring Plan <br />• Rule 2.05.3 - Operation Plan <br />• Rule 2.05.4 - Reclamation Plan <br />• Rule 3.02 - Performance Bond Requirements for Surface Coal Mining <br />and Reclamation <br />• <br />PR-02 1 6/10
