It is recommended that a water <br />court decree be obtained to affirm the priority of the use of water associated with this operation. Any <br />exposed ground water must be backfilled immediately until a well permit issued pursuant to CRS 37- <br />90-137(2), allowing the exposure of ground water in a pit, is obtained from the State Engineer. <br />COMMENTS/NOTES: It would appear this pond is currently used for stock watering and spring runoff <br />collection; it utilizes a dam to retain the water. The applicant should be aware that the pond is located in an <br />overappropriated stream system. The pond must have a low level outlet to allow for water releases in the <br />instance there is a call on the stream. Also, dams over 10 feet high are considered jurisdictional dams and <br />are regulated through the Dam Safety branch of DWR. The applicant should contact Mark Haynes, Chief of <br />Dam Safety, at mark. haynes (o)state.co.us to assess whether this dam would be classified as a jurisdictional <br />dam.
