Cattany <br />Windsor, CO 80550 Division Director <br /> Natural Resource Trustee <br />Re: Carbon Junction Mine, DRMS Permit C-92-080 <br />Permit Renewal 3 (RN-03) <br />Adequacy Review <br />Dear Mr. Savage: <br />DRMS has reviewed your letter of July 2, 2008 in which you responded to our <br />preliminary adequacy comments (DRMS letter of April 11, 2008). Your responses <br />satisfy all of our comments for Permit Renewal 3 (RN-03). <br />Regarding our comment 2 in the April 11 letter, although our comment addressed topsoil <br />stockpile number 4 and your response addressed topsoil stockpile number 7, we agree <br />that regrading of topsoil stockpile 7 is unwarranted. Since our April 11 letter, the <br />Division has also determined that further regrading of stockpile number 4 is unwarranted <br />because only a relatively small part of the stockpile on the north slope is excessively <br />steep (see our June 2008 inspection report).
