This TDN was issued in response to a citizen complaint from JoEllen Turner, and
interprets her allegations to mean that "suitable subsoil material was not handled or stored in a
manner that would prevent contamination which would lessen the capacity of the material to
support vegetation when redistributed." This inspection was initially scheduled as part of the
Division's normal I & E program; the timing of the inspection also provided an opportunity to
investigate the violations alleged with this TDN.
AIR RESOURCE PROTECTION —Rule 4.17:
The water truck was observed, spraying the southern ramp into the pit (Photo 1).
EXPLOSIVES — Rule 4.08
The drill rig was drilling a pattern on the parcel owned by WFC (Photo 2). A completed drill
pattern was established a distance north of where the rig was located, but had not yet been loaded
for the next shot.
FISH and WILDLIFE — Rule 4.18:
A variety of ducks were congregating at Pond 007, where the ice has partially melted and open
water was available.
GENERAL MINE PLAN COMPLANCE:
The Mine Shovel was not in operation at the time of the inspection, so the mine's haul trucks
were parked. Over - the -road haul trucks were transporting coal from the permit area to the Tri-
State Nucla Station.
Number of Partial Inspection this Fiscal Year: 6
Number of Complete Inspections this Fiscal Year: 2 Page 2 of 7
