Cheryl Signs, P.E. <br />Durham Pit, DRMS-1978-056 <br />Page 3 <br />February 14, 2011 <br />Replacement <br />The proposed source of replacement for this pit is 48.7 acre-feet (93.18 acre-feet of headgate <br />deliveries and 44.5 acre-feet of return flow obligations) of historic stream depletions from the dry-up of <br />33.7 acres of land historically irrigated with five shares of Greeley Irrigation Company's interests in <br />Greeley Canal No. 3 and 2.9 acre-feet (4.9 acre-feet of deliveries and 2 acre-feet of return flow <br />obligations) of historic stream depletions in the applicant's interest in the Fossil Creek Reservoir diverted <br />from the Cache la Poudre River and previously used for irrigation of the mined property. The values for <br />the historical use credits of the five shares of Greeley Canal No. 3 were prorated from the historical use <br />analysis values decreed for the Greeley Irrigation Company in Case No. 96CW658. After applying the five <br />shares of Greeley Canal No. 3 and the Fossil Creek Reservoir water, there will be 26.76 acre-feet of <br />uncompensated depletions. <br />Additional replacements for depletions during the non-irrigation season and during months with <br />insufficient credits will be made by releases from water stored in Dakolios Pit and 112 Reservoir. The <br />water in storage is primarily junior water rights that were decreed in case no. 2001 CW274 (1,237 acre- <br />feet). <br />Water was diverted through the Rural Ditch for storage in the 112 Reservoir and the Dakolios <br />Reservoir over the extended free river period that started in September 2009 and continued through <br />the beginning of June 2010. According to the decree in case no. 2001 CW274, water stored in the <br />reservoirs or used directly at the point of diversion may be used for replacement of depletions at the <br />mining sites owned or leased by VCI. The Durham Pit site has been identified as one of the mining <br />sites where the junior water rights decreed in case no. 2001 CW274 may be used as a source of <br />replacement water. You indicated that as of November 2010 the water stored in the 112 Reservoir and <br />Dakolios Reservoir totaled 1,468 acre-feet consisting of a combination of Rural Ditch water and junior <br />water decreed in case no. 2001 CW274. The attached Tables 2A and 2B show the reservoirs <br />operations over the next two years. The average ground water contribution and direct and indirect <br />precipitation for the two pits has been included in the study. The Applicant intends to use the junior <br />water instead of the Rural Ditch water that had previously been stored in the 112 Reservoir. Thus, the <br />replacements for depletions at Durham Pit will be satisfied by delivery of junior water decreed in case <br />no. 2001 CW274 and previously stored in the 112 and Dakolios Reservoirs. Delivery of augmentation <br />water to the Cache La Poudre River is subject to transit losses as determined by the water <br />commissioner and the division engineer. <br />The water rights decreed in case no. 2001 CW274 can be used directly at the points of diversion <br />or retained in reservoirs for storage when the water rights are in priority or used by exchange for <br />releases from any or all of the reservoirs or any or all of the direct flow sources.
