The Division has identified four.epproachas for operators: <br />1. File a financial warranty thetwill ensure baddliilnt ofthe pit to cover the exposed pound water to a <br />depth of two feet above the static pound water level or, <br />2. Obtain a court approved augmentation plan prior to exposingground water or, <br />3. File a financial warranty to cover the cost of installing a day liner or slurry wall that meats the <br />Ohrislon of Water Resources requirements for preventing pound water exposure or, <br />4. Obteln approval from the Division of Water Resources 'that adtnowledges compliance with the SEtYs <br />requirements pursuant to 137-9(1-137(31).' <br />The Division will work with operators on on Indhrldual basis as they move to Implement one of these plans.. R <br />Is likely that options 1 and 3 will require the submittal of a technical mvislon or an amendment to the existing <br />permit depending on the nature of the parent minim and redsmstkm plan and the proposed changes. <br />Increased fnandal warrontlis, as a result of these modifications, may be posted in a phased manner not to <br />exceed tine yam Amendments or ralslons currently under review will be required to be approved by <br />April 30, 2011 and may use the phased financial warranty approach daicrlbed above. New appllcitions soft <br />forwird or presently under review bythe Division will be required to meet the requirements of one of the <br />options 1.4 at the time of appli adon•approval.
