(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1986-079 <br />INSPECTION DATE: 04 October 2010 INSPECTOR'S INITIALS: DB2 <br />OBSERVATIONS <br />This inspection was conducted by David Bird and Tony Waldron of DRMS along with Steve Brown and Anne <br />Best Johnson representing the operator. The site is located about % of a mile south-southwest of Henderson <br />at the southeast intersection of East 120th Avenue and Brighton Road. Mining is complete and the site is in <br />reclamation. Sand and gravel were the commodities produced at the site. The total permit area is 70.5 acres, <br />and the Division holds financial warranty in the amount of $680,666 for the operation. The post-mining land <br />use is described as wildlife habitat. <br />The purpose of the inspection was to evaluate the operator's request for partial surety release for all but the <br />remaining revegetation. The inspection revealed that, in addition to the revegetation, two additional tasks must <br />be performed to ready the site for full release of performance and financial warranties. Following are the <br />reclamation tasks remaining: <br />1) The slopes of the lakeshore do not yet appear to be in conformance with Construction Materials Rule <br />3.1.5(7) which states that, unless otherwise approved by the Board or Office, lakeshore slopes 5 feet above to <br />10 feet below the expected water line must be no steeper than 3 horizontal to 1 vertical and 2:1 elsewhere. <br />Unless the operator can produce documentation showing that the existing slope configuration was approved by <br />the Office, the slopes must be configured as specified in Rule 3.1.5(7) before release will be granted. <br />2) The operator must conduct weed control activity in accordance with Rule 3.1.10(6) and provide evidence of <br />the activity to the Division. <br />3) The revegetation effort initially done for reclamation was not 100 percent successful. Before release, the <br />operator must revegetate those areas of the permit that did not successfully re-establish from the initial <br />seeding effort, and demonstrate after one growing season that the revegetation effort was successful. <br />In the meantime, all but $9,700 of the financial warranty can be released at this time, with the remaining <br />financial warranty held needed to account for the tasks listed above. <br />I & E Contact Address <br />NAME: Anne Best Johnson <br />OPERATOR: Lafarge North America <br />STREET: 10170 Church Ranch Way.
