Pineda <br />Director <br />The Division of Reclamation, Mining, & Safety (Division) has reviewed the above referenced permit <br />application and determined that the following issues remain to be addressed for the application to meet <br />the requirements of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board <br />for Hard Rock, Metal, and Designated Mining Operations. <br />1) Rule 6.3.1 Exhibit A - Legal Description and Location Map <br />The names of the immediately adjacent surface owners of record are shown on Exhibit E1 Map, but the <br />Division is unable to determine from the information given if you have adequately identified the surface <br />owner(s) of record immediately to the north of the proposed permit area. Please either provide this <br />information or indicate where in the application the information may be found. <br />2) Rule 6.3.2 Exhibit B - Site Description <br />Exhibit E Map does not appear to show all of the permanent man-made structures that are described in <br />the text, such as the Telecom line and the natural gas line. As required by Rule 6.3.2 (b), please plot all <br />permanent man-made structures on Exhibit E Map. <br />3) Rule 6.3.4 Exhibit D - Reclamation Plan: <br />A) The application briefly mentions fertilization elsewhere, but no specifics are provided in the relevant <br />section 6.3.4(1)(c)(ii). As required by Rule 6.3.4(1)(c)(ii), please provide details of fertilizer types and <br />application methods in this section. <br />B) Because the NRCS letter specifically states that the importation of topsoil will be probable, please <br />provide a commitment in this section to import topsoil if needed.
