The revision was <br />submitted by New Elk Coal Company, LLC. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />This revision proposes an increase to the permit boundary of 22.5 acres within the DOW owned surface and coal. <br />It also proposes "development only" mining in the Allen seam north of the existing portals and "development and <br />retreat" mining in the Apache seam south of the existing portals. Subsidence impacts and mitigation on the <br />Bosque del Oso SWA are addressed under pending Permit Revision No. 2, previously provided to you. Since <br />these revisions are being reviewed concurrently, the applicant chose not to duplicate permitting materials under <br />this revision. <br />The underground coal mining operation is on land located approximately 25 miles West of Trinidad, Colorado. <br />The permit area is further described as follows: T33S, R68W, portions of Sections 24; 25, and 26. All sections are <br />partially or fully projected by New Elk Coal Company due to the unsurveyed nature of the Maxwell Lai. rant. <br />The above-mentioned tracts of land are shown on the USGS 7.5 minute Quadrangle maps of Vigil, Tercio, and <br />Stonewall. <br />Because the above referenced technical revision application would incorporate additional lands into the permit <br />area or might otherwise alter previously approved permit conditions or mitigation measures, we are requesting <br />your agency's evaluation of the proposal. Your comments and concerns relating to the adequacy of fish and <br />wildlife resources information, the fish and wildlife plan, and the reclamation plan as it relates to fish and wildlife <br />considerations, including potential impacts to threatened or endangered species, are requested. If wildlife habitat <br />is the proposed postmining land use, we request your evaluation of proposed woody plant stocking levels, planting <br />arrangements, and methods for mitigation of potential adverse impacts. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
