Pineda <br />Director <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of <br />Minor Revision No. 33 (MR-33) for the Bear No. 3 Mine and has the following comments: <br />1. Item number 1 of the MR-33 submittal cover page concerns the retention of the power pole and <br />mentions the DMEA letter and the Mountain Coal Company letter. However, only the DMEA <br />letter is referenced on revised page 2.05-27. Please revise page 2.05-27 to also reference the <br />Mountain Coal Company letter and its location in the permit application. <br />2. Item number 2 of the MR-33 submittal cover page mentions revised page 2.05-32. However, this <br />revised page was not included in the MR-33 submittal. Please submit revised page 2.05-32. Also, <br />if not already done, please reference the Mountain Coal Company letter and its location in the <br />permit application in the discussion of the bridge on revised page 2.05-32. <br />Item number 3 of the MR-33 submittal cover letter concerns a discussion of the reclamation of <br />the hillside spring water treatment pond, which was added to revised pages 2.05-31 and 2.05-35a. <br />Unfortunately, the Division forgot to request in the January 5, 2011 letter to the Bear Coal <br />Company that the disposition of the hillside spring should also be mentioned.
