Pineda <br />Director <br />The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed and found the above referenced <br />report to be in compliance with the following regulations: <br />4.05.9(14)(b) - The impoundment has been maintained as designed, in accordance with the approved <br />plan and the applicable regulations. <br />4.05.9(15) - Certified inspection reports shall include: Any appearance of erosion, instability, <br />structural weakness or other hazardous conditions. <br />4.05.9(17) - All impoundments shall be examined at least quarterly by a qualified person designated <br />by the operator, for appearance of structural weakness and other hazardous conditions. <br />4.05.9(17) - A copy of the report shall be submitted to the Division on a quarterly basis. <br />The fourth quarter sediment pond inspection reports were received by the Division on January 31, 2011. Sediment pond <br />inspections were conducted by TMI between November 4 and December 31, 2010. <br />From the inspection reports, the identified maintenance items include: <br />• replacement of identification signs for No Name #2, Middle Flume #3, East Middle Flume, and Horse #1; <br />• replacement of sediment marker for No Name #5, Horse #1; <br />repair of the riser for No Name #4; <br />filling of burrows on the Johnson #6 embankment. <br />There are discrepancies regarding the level of sediment in Grouse #1 Pond and Horse Gulch Pond. The inspection <br />reports indicate that these ponds contain minimal sediment; however the summary table indicates that they do contain <br />sediment (50% in Grouse #1 and 25% in Horse). Also, the Industrial Waste Pond is not included in the summary table, <br />nor are the maintenance items in the inspection report listed in the cover letter of the submittal. Please clarify these <br />discrepancies. <br />Note that some maintenance items have been identified during prior inspections and should be addressed as soon as <br />practical.
