NOTICE OF PROPOSED, DECISION
The Colorado Division of Reclamation, Mining and Safety:.
proposes to approve Permit Revision Application No. S, ;
submitted by New Elk Coal Company, LLC for a coal Olin- ;
ing permit at the New Elk Mine (Permit No. C-1981-012).
The applicant proposes to construct and operate coal
loadout facility at the Jansen rail yard located west of
Trinidad. This ten acre area has been previously dis-
turbed. The applicant is not proposing any new distur-
bance. Operations are planned as temporary, for two or
three years, until the rail spur can be re-established to the
New Elk Mine site 25 miles to the west.
The New Elk Mine is located in Las Animas County,.ap-
proximately 25 miles'west of Trinidad, Colorado. The un-
derground operation has an anticipated initial production
capacity of one million tons per year. Coal interest- Is
State and private, and the surface to be affected is State
and private land. The permit area encompasses approxi-
mately 1,608.50 acres. The land at the coal loadout Is
also privately owned.
This proposed decision is based on a finding that the pro-
posed operation will comply with all requirements of Ow
Colorado Surface Coal Mining Reclamation Act, Section
34-33-101, et seq., C.R.S., and the regulations promul-
gated thereunder;
Copies of the proposed decision, including any stipule-
tions, are on file for public inspection at the Colorado Divi-
sion of Reclamation, Mining and Safety, Room 215; Gn
tennial Building, 1313 Sherman Street, Denver, Colorado
80203 and at the Las Animas County Clerk and Recorder,
200 East First Street, Room 104, Trinidad, CO 81082.
Persons with an interest that may be adversely affected
by the proposed decision may request a formal hearirp
before the Mined Land Reclamation Board on the pro-
posed decision. Such request must be made within Oft
(30) days of the initial publication of this notice, must be In
writing, and must state with reasonable specificity the rea-
sons for the request and the objections to the proposed,
decision.
