Pineda <br />Canon City, Colorado 81212 Director <br />RE: Notice of Intent (NOI) to Conduct Prospecting Operations Application <br />Stanley Mine; P-2011-001; Adequacy Review #2 <br />Dear Mr. Fabrizio, <br />The Division of Reclamation, Mining and Safety (Division) received your response to the first adequacy <br />review of the Notice of Intent (NOI) to Conduct Prospecting Operations for Hard Rock/Metal Mines at <br />the Stanley Mine; File No. P-2011-001. Your response was received on February 2, 2011. The Division <br />has reviewed the submitted material for adequacy. Please address the following items; <br />Project Description: <br />1.) The copy of the Stanley Mine plat map submitted in your response did not have a scale drawn or <br />indicated on the map. However, based on some of the dimensions shown on the map, the <br />Division estimated the area highlighted as the "permit area" to be 7,843 square feet, not the <br />quarter acre discussed later in your response. Does this map depict the entire area to be affected <br />by the prospecting operation? If not, please re-submit a map depicting the total surface area <br />involved with the operation. Please ensure the submitted map is drawn at a proper scale with the <br />scale depicted on the map. <br />2.) Prior to Division approval of the NOI, the Applicant must demonstrate the conditions beyond the <br />cave-in are dry. Based on the site visit yesterday, there did not appear to be any water coming out <br />of the adit. Given the number of drifts and stopes below the adit anticipated to be used for the <br />prospecting operation, it is unlikely there is water beyond the cave in, however it is not <br />impossibility. As discussed yesterday, the Division would like to conduct a follow-up inspection <br />as soon as possible to observe the caved in area to determine the conditions at that location. <br />3.) Please describe the condition of 30x3Oxl2 foot dump area and what work will need to be done to <br />improve this area to be used for the operation? <br />a. Please indicate the thickness of the concrete walls and floor to be installed. <br />b. Describe what measures will be taken to prevent stormwater from entering and exiting <br />the waste pit to prevent acid and toxic runoff from the waste material. <br />4.) The Applicant did not provide the letter from the Division of Water Resources (DWR) or "State <br />Water Engineer" as they are referred to in the original application. The Division received a letter <br />from the DWR on February 3, 2011. A copy of the letter is enclosed for your review.
