This exhibit included several maps titled "Site Preparation Phase 1". <br />Please indicate when the "Site Preparation Phase 1" operation will be conducted. Also, please include <br />a narrative that specifically identifies all the activities to be conducted as part of the site preparation.. <br />The Site Preparation Phase 1 plan was prepared in anticipation of the slurry wall construction occurring <br />immediately after approval by the DRMS and SEO. However, the slung work is currently on hold and <br />therefore, this "Phase 1" of work will likely occur as part of the slurry and embankment construction. <br />The information was only provided to address your comments regarding our long-term plan to control <br />groundwater mounding after slurry wall construction and is only anticipated to occur as part of the slurry <br />wall construction project.. <br />7) Please provide specifications and designs for the proposed "Drainage Outfall to the River" structures. <br />The Phase 1 information was only provided to address your comments regarding our long-term plan to <br />control groundwater mounding and is not part of our current amendment. We are not asking for <br />approval by the DRMS of this phase of work (refer Response 6. Above) and will submit a Technical <br />Revision for this work, if so required, prior to completion. <br />8) The site preparation maps indicate several areas will be used for soil/spoil storage. How long will this <br />material be stockpiled? How will the stockpiles be configured and stabilized to protect against wind and <br />water erosion? <br />The Phase 1 information was only provided to address your comments regarding our long-term plan to <br />control groundwater mounding and is not part of our current amendment. We are not asking for <br />approval by the DRMS of this phase of work (refer Response 6. Above) and will submit a Technical <br />Revision for this work, if so required, prior to completion. <br />9) Map P1-5 indicated two ponds will be created or have already been created. The map also indicates <br />there is an existing pump/well in this location to be used for construction purposes. Will water be <br />impounded in these ponds for longer than 72 hours? If so, does the current approved temporary <br />substitute water supply plan cover the evaporative loss of the impounded water? Please submit <br />documentation that the Operator has adequate water rights and that the water from the pump/well is <br />approved to be used for construction use. <br />The Owner is obligated to submit an accurate TSSP reflecting all depletions resulting from the mining <br />and will complete that update as required by the State Engineer's Office. The Phase 1 information was <br />only provided to address your comments regarding our long-term plan to control groundwater mounding <br />and is not part of our current amendment. We are not asking for approval by the DRMS of this phase of <br />work (refer Response 6. Above) and will submit a Technical Revision for this work, if so required, prior <br />to completion. <br />6.4.19 EXHIBIT S - Permanent Man-Made Structures <br />10) According to the response to item 20 of the Divisions Adequacy Review. The applicant committed to <br />not mining within 200 feet of the following structures: <br />a. Structure #2; Oil/Gas Wells and Facilities owned by Petro Canada <br />b. Structure #7; Utility Line owned by Xcel Energy <br />c. Structure #8; Buildings owned by Ptasnik Land Company <br />It appears the owner for Structure #2 has changed to Noble Energy. Please commit to marking these <br />structures in the field, as well as the 200 foot setback until the structure damage reimbursement <br />agreements have been submitted and approved by the Division. If the application is approved, a
