February 11, 2011 <br />Adams County Board of Commissioners <br />Final Agency Action: Recommendation for Approval of Certificate of Designation Application with Conditions <br />Frei-Henderson Inert Fill, Adams County, Colorado <br />Page 4 <br />Please note that pursuant to Section 1.8.4(A) of the Solid Waste Regulations an approved closure cost <br />estimate and closure and post-closure financial assurance mechanisms must be established at least sixty <br />(60) days prior to initial receipt of waste. Pursuant to Section 1.8.3 of the Solid Waste Regulations, the <br />closure and post-closure cost estimates must be adjusted annually to account for inflation or deflation by <br />using the implicit price deflator for the gross domestic product. AFS must submit new closure and post- <br />closure cost estimates to the Division for review and approval every five (5) years unless otherwise <br />required by the Division based on conditions at the site. <br />In addition to complying with the approved DOP, Solid Waste Regulations, and CD conditions, AFS must comply <br />with all relevant federal, state, and local regulations including but not limited to the requirements of the Division <br />of Reclamation Mining and Safety, the Division of Water Resources, the Water Quality Control Division, and the <br />Air Pollution Control Division. <br />The Division is authorized to bill for its review of technical submittals at a rate of $125 per hour pursuant to <br />Section 1.7 of the Solid Waste Regulations.
