Section III - Reclamation Liability <br />At the time of the issuance of Permit Renewal No. 5, the Division was holding three bond documents totaling <br />$278,000.00. However, with the approval of Minor Revision No. 25 and the change in the permittee and <br />operator name from the Terror Creek Company to Terror Creek LLC, the three bond documents were replaced <br />by one bond document. Currently, the approved bond is Corporate Surety No. for $278,000.00, <br />issued by the Travelers Casualty and Surety Company of America. <br />During the midterm permit review process, the reclamation bond is reviewed pursuant to Rule 3.02.2(4) in order <br />to determine whether the above total bond amount held by the State is sufficient to cover the costs of the <br />Division's projection of reclamation costs for worst-case disturbance that has occurred during the proposed <br />permit term (2.07.6.(2)0)). However, as stated in item number 6 below, the Division will delay its calculation of <br />the midterm review cost estimate until the adequacy review questions relevant to the reclamation liability are <br />answered by TCLLC. <br />Section IV - Adequacy Review <br />The following are the Division's questions and comments for this midterm permit review. The Division requests <br />that responses be submitted through this midterm review. When all of the midterm adequacy issues have been <br />resolved, the Terror Creek Company can submit the revised pages and maps in a minor revision. <br />Rule 2.03 <br />1. Please update Section 2.03.4, Identification of Interests, of the permit application if applicable. The <br />updates should include corporate ownership and control information as well as surface ownership <br />information. Also, please update Map 1, Surface Ownership, if applicable. <br />2. Please update the compliance information in Section 2.03.5 of the permit application, if applicable. <br />Please update Section 2.05.3 to describe the relationship of TCLLC with the private trucking company <br />that is using the warehouse and a portion of the parking lot. Please include in the description the <br />continuing liability of TCLLC concerning the facilities. <br />4. Please update the information in the inventory of storage tanks that appears on page 2.05-2b of Volume <br />1, if necessary. <br />Rule 2.07.6 <br />Under Rule 2.07.6(1)(b), the Division is required to perform a check of the Applicant Violator System <br />(AVS) for the 2011 Midterm Review. When completed, the Division will inform TCLLC of the results. <br />Rule 3.02 <br />6. The Division will calculate the reclamation liability for the Terror Creek Loadout after TCLLC responds <br />to items numbers 3 and 4 above.
