V. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve the request for a partial <br />Phase I bond release for the Trapper Mine. This proposed decision will release the applicant <br />from reclamation liability for Phase I bond release criteria on bond release blocks F-AB-08 and <br />Z-A-08, totaling 57.8 acres. <br />As noted above, Trapper Mine is an active mine with two pits where TMI is actively mining <br />coal and two pits that have been approved to receive flyash. Reclamation at the Trapper Mine <br />continues as the mining of pits progresses. On active mine areas, backfill and grading, topsoil <br />redistribution, seeding, and transplanting will continue. <br />The reclamation cost estimate was last evaluated and updated as part of the 2010 midterm <br />review of the Trapper Mine permit. The Division estimates the cost to complete remaining <br />reclamation work at the site to be $28,797,697.00. The Division currently holds a performance <br />bond of $30,173,724.00. <br />With SL-11, Trapper Mine did not request a return of bond monies held, only a reduction in the <br />amount of the site's reclamation liability because the areas in question (blocks F-AB-08 and Z- <br />A-08) have been backfilled and graded, and the drainage control structures on these areas have <br />been constructed, per the terms of the permit. <br />Any person with a valid legal interest which might be adversely affected by this <br />proposed decision may request a formal public hearing before the Mined Land <br />Reclamation Board in accordance with Rule 3.03.2(6). Public notice of this proposed <br />decision will be published in the Craig Daily Press once a week for two consecutive <br />weeks as soon as possible. Requests for public hearing must be submitted to the <br />Division in writing within 30 days of the first publication.
