Pineda <br />Director <br />Re: Rock Gulch Pit, M-1980-041, Conversion Application, CN-01, Final Issues and Financial <br />Warranty Review. <br />Dear Ms. Bellantoni, <br />The Division of Reclamation Mining and Safety (Division) has finished the adequacy review of <br />the above referenced 112c conversion application. A pre-operational inspection was <br />conducted on February 14, 2011. A minor clarification needs to be addressed which is noted <br />below but overall no issues were noted that are not addressed. <br />In order to finish the process and be able to issue a decision staff needs some final <br />documentation, a clarification and acceptance of the financial warranty update. Please submit <br />the following: <br />• Per Rule 1.6.5 the Public Notice and comments ends on February 23, 2011. The Division <br />needs a signed affidavit of publication from the paper as proof of publication. <br />• An unsigned damage agreement between the operator and county was submitted. The <br />Division will need the signed agreement prior to issuing a decision. <br />• Enclosed is an updated reclamation liability estimate. The estimated cost for reclaiming <br />a maximum 10 acre disturbance is $30,952.71. This is $47.29 less than the current bond <br />held. Therefore no increase is required. Staff requests written confirmation that the <br />bond estimate amount is acceptable. <br />• During the onsite inspection imported concrete was observed. Mr. Treat noted that the <br />material was crushed and recycled. Please confirm that none of the material will remain <br />on site for use as backfill material. If some of the material will be used as backfill now or <br />in the future then the Division needs an affidavit for inert fill importation per Rule <br />3.1.5(9). Please note that the affidavit can be included as part of the conversion review <br />at no cost. If in the future it is decided that using the material for backfill would be <br />advantageous and the affidavit is not in place then a technical revision and fee will be <br />required. Also please note that any stockpile larger than the small amount observed <br />could impact the reclamation liability for disposal.
