Dear Ms. Bellantoni,
The Division of Reclamation Mining and Safety (Division) has finished the adequacy review of
the above referenced 112c conversion application. A pre-operational inspection was
conducted on February 14, 2011. A minor clarification needs to be addressed which is noted
below but overall no issues were noted that are not addressed.
In order to finish the process and be able to issue a decision staff needs some final
documentation, a clarification and acceptance of the financial warranty update. Please submit
the following:
• Per Rule 1.6.5 the Public Notice and comments ends on February 23, 2011. The Division
needs a signed affidavit of publication from the paper as proof of publication.
• An unsigned damage agreement between the operator and county was submitted. The
Division will need the signed agreement prior to issuing a decision.
• Enclosed is an updated reclamation liability estimate. The estimated cost for reclaiming
a maximum 10 acre disturbance is $30,952.71. This is $47.29 less than the current bond
held. Therefore no increase is required. Staff requests written confirmation that the
bond estimate amount is acceptable.
• During the onsite inspection imported concrete was observed. Mr. Treat noted that the
material was crushed and recycled. Please confirm that none of the material will remain
on site for use as backfill material. If some of the material will be used as backfill now or
in the future then the Division needs an affidavit for inert fill importation per Rule
3.1.5(9). Please note that the affidavit can be included as part of the conversion review
at no cost. If in the future it is decided that using the material for backfill would be
advantageous and the affidavit is not in place then a technical revision and fee will be
required. Also please note that any stockpile larger than the small amount observed
could impact the reclamation liability for disposal. It is in the operator's best interest to
keep the piles small at all times or recycle quickly if a large amount is planned.
