I Delta Paving Pits Ruling of Referee - Case 99CW 128 Page 2 Findings Re: First Claim for Relief (Underground Water Rights) 4. General Project Description: Applicant is mining sand, gravel and related products from the Delta Paving Pits and from the property on which it is located. The property is located near the Gunnison River. During and after the mining of the property, groundwater will be exposed to the atmosphere and will be used for mining and reclamation purposes. The property will be mined to a maximum depth of approximately twenty-five feet, and will create ;c ponds with a total maximum surface area of 60 acres. These ponds will remain after the completion of mining activities. 5. Name of Structures: The Delta Paving Pit Wells, consisting of Delta Paving Pit Well No. 1, Delta Paving Pit Well No. 2, Delta Paving Pit Well No. 3, Delta Paving Pit Well No. 4, and Delta Paving Pit Well No. 5. 6. Other Wells: There are no other existing wells within six hundred feet of the Delta Paving Pit Wells. 7. Legal Description of Point of Structures: The Delta Paving Pit Wells will be located in the south half of Section 3 and the north half of Section 10, T. 15 S., R. 95 W., 6th P.M., at the following locations: Delta Paving Pit Well No. 1: 2200 feet West of the East line and 200 feet North of the South line of said Section 3. Delta Paving Pit Well No. 2: 1700 feet West of the East line and 300 feet North of the South line of said Section 3. Delta Paving Pit Well No. 3: 1100 feet West of the East line and 400 feet North of the South line of said Section 3. Delta Paving Pit Well No. 4: 1600 feet West of the East line and 800 feet South of the North line of said Section 10. Delta Paving Pit Well No. 5: 2300 feet West of the East line and 1600 feet South of the North line of said Section 10. A map of the locations of the Delta Paving Pit Wells is attached hereto as Exhibit A.
