BASIN MD <br />APPROVED WELL LOCATION <br />DELTA COUNTY <br />DELTA PAVING LLC 114 SE 1/4 Section 3 <br />% RONALD E TIPPING Township 15 S Range 95 W Sixth P.M. <br />p O BOX 1849 <br />GRAND JUNCTION, CO 81502- DISTANCES FROM SECTION LINE <br />0 Ft. from Section Line <br />(970) 2434604 W 0 Ft. from Section Line <br />ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT <br />CONDTT19NS F APPROVAL <br />1) This well shall be used in such a way as to cause no material Injury to existing water rights, The issuance of this permit <br />does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested <br />water right from seeking relief in a civil court action. <br />2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval <br />of a variance has been granted by the State Hoard of Examiners of Water Well Construction and Pump Installation <br />Contractors in accordance with Rule 18. <br />3) Approved pursuant to CRS 37-90-137 (2) and (11) on the condition that this well is operated in accordance with the Delta <br />Paving LLC Augmentation Plan approved by the Division 4 Water Court in case no. 99CW128, If this well is not operated in <br />accordance with the terms of said decree, it will be subject to administration including orders to cease diverting water. <br />4) The average annual amount of ground water to be appropriated shall not exceed 225.15 acre-feet with the total surface <br />area of the ground water ponds limited to 60 acres. These ponds are known as the Delta Paving PH Wells Nos. 1 - 5. <br />CDMG No. M-98-105. Nos. 1 - 3 are located in the SE14 of Section 3 and Nos. 4 & 5 are located in the NEA of Section 10. <br />5) The use of ground water, in addition to evaporation (218.75 acre-feet/year), is limited to dust suppression (2.7 <br />acre-feetlyear), product moisture loss (3.7 acre-feetlyear), aggregate washing, and dewatering. No other use of water is <br />allowed unless a permit therefor Is approved. <br />6) The owner shall mark the wells (ponds) In a conspicuous place with well permit number(s), and court case number(s) as <br />appropriate. The owner shall take necessary means and precautions to preserve these markings. <br />7) The provision of the Minimum Construction Standards In Rule 10 shall be waived for gravel pits except for Rules 10.1 and <br />10.2.1 regarding aquifer contaminants. The owner of the gravel pits shall take necessary means and precautions to <br />prevent contaminants from entering the gravel pit wells. <br />8) The boundaries of the ground water ponds/gravel pits shall be more than 600 feet from any existing well not owned by the <br />applicant. <br />9) No permanent pumping equipment shall be installed within the confines of the ground water ponds/gravel pits, unless a <br />seperate written request for a variance has been approved by the State Board of Examiners of Water Well Construction and <br />Pump Installation Contractors. <br />10) permanent records of all diversions must be maintained by the well owner (recorded at least annually) and submitted to <br />the Division Engineer upon request. <br />11) The owner shall submit plan and cross section drawings on 8.112" x 11" paper showing the extent of excavations, the <br />maximum depths of the pits, and the initial static water levels.
