<br />Delta Paving Pits <br />Ruling of Referee - Case 99CW 128 <br />Page 6 <br />(II) Water will be withdrawn from the Delta Paving Pit Wells as product moisture <br />and for aggregate washing purposes during mining operations. The product mined from the <br />Delta Paving Pit Wells will include product moisture in the amount of four percent (4%) of <br />the material mined during the year, and water will be pumped from the Delta Paving Pit <br />Wells at the maximum rate of 1,000 g.p.m. for aggregate washing purposes. Of the total <br />amount of water withdrawn and diverted as product moisture and for gravel washing <br />purposes, 3.7 acre feet per year will be depletions to the river system (based upon 125,000 <br />tons of product mined per year and a moisture content of four percent (4%) of the product <br />mined by weight). The remainder of the amount diverted will be discharged back into the <br />Delta Paving Pit Wells or into the Gunnison River adjacent to the Pits. The Applicant <br />anticipates that the diversions and depletions will occur primarily during the months of May <br />through September of each year. However, depending on demands for gravel, such <br />diversions and depletions could occur at any time during the year, both during and outside <br />of the Call Period. <br />(III) Water will be withdrawn from the Delta Paving Pit Wells for dust suppression <br />purposes during mining operations. Some of this water will be used for dust suppression in <br />gravel crushing operations, and some will be used to suppress dust on roads. The total <br />amount of water to be withdrawn and used for dust suppression purposes is anticipated to be <br />2.70 acre feet per year, calculated as follows: <br />(1) 0.79 acre feet per year for gravel crushing dust suppression, based upon <br />application at a rate of 15 g.p.m. for 12 hours per day for 24 days during the year; <br />and <br />(2) 1.91 acre feet per year for dust suppression on roads, based upon application at <br />the rate of 6,000 gallons per day for 104 days per year. <br />The use of water for dust suppression purposes will be 100% consumptive. Applicant <br />anticipates that water will be diverted through September of each year, and that water for <br />gravel crushing dust suppression will be diverted in May or June of each year. However, <br />depending on demands for gravel, such diversions and depletions could occur at any time <br />during the year, both during and outside of the Call Period. <br />(IV) Evaporation losses from the Delta Paving Pit Wells will occur both during <br />mining operations and after mining operations are completed. All other diversions and <br />depletions will occur only while mining operations at the Delta Paving Pit Wells are <br />ongoing. Once mining operations have been completed at the Delta Paving Pit Wells, these <br />other diversions and depletions will cease.
