The name of the water right that is the subject matter of the Application (the <br />AWater Right@), its originally decreed civil action number, decree date, court, location, source, <br />priority date, amount, and uses are as follows: <br />A. 23 Road Pit Enlargement <br />Date of Original Decree: <br />Case No.: <br />Court: <br />August 10, 1998 <br />98 CW 014 <br />Water Court, Water Division No. 5 <br />ii. Subsequent Decrees: <br />None <br />Location: The 23 Road Pit Enlargement is located in portions of the <br />NW1/4 SW1/4 and the SW1/4 SW1/4 of Section 5, T.1 S., R.1 W., <br />Ute P.M. The center of the Pit will be located approximately 200 feet <br />East of the West Section Line and 1700 feet North of the South <br />Section Line of said Section 5. <br />iv. Source: The 23 Road Pit Enlargement is a gravel pit located in <br />alluvial deposits adjacent to the Colorado River, and intercepts and <br />withdraws groundwater tributary to the Colorado River. The <br />estimated total depth of the pit is twenty-four feet. <br />V. Appropriation Date: October 22, 1997. <br />vi. Amount: 125.4 acre feet, conditional. <br />vii. Uses: The uses of water are for industrial uses, including dewatering <br />of 23 Road Pit Enlargement during mining, evaporation during <br />mining activities and after completion of mining activities from the <br />pond resulting from mining activities, dust suppression, product <br />moisture losses through aggregate removal and processing, and <br />aggregate washing, all in connection with the mining of sand, gravel, <br />and related products from land on which the 23 Road Pit Enlargement <br />is located, and with the reclamation and use of such land during and <br />after completion of such mining.
