The name of the water right that is the subject matter of the Application (the "Water <br />Right"), its originally decreed civil action number, decree date, court, subsequent decrees, location, <br />source, priority date, amount, and uses are as follows: <br />A. <br />Name of Structure: Arcuby Pit <br />Date of Original Decree: April 25, 1993 <br />Case No.: 90 CW 261, Water Court, Water Division 5 <br />ii. Subsequent Decree: July 10, 2000 <br />Case No.: 99 CW 57, Water Court, Water Division 5 <br />iii. Location: Three pits located in the NE1/4 SW1/4 and in Lots 1 and 2 of <br />Section 20, TIN, R2W, Ute P.M. The center of Pit No. 1 is located <br />approximately 1900 feet West of the East section line and 1000 feet North of <br />the South section line of said Section 20. The center of Pit No. 2 is located <br />approximately 1900 feet East of the West Section line and 1150 feet North <br />of the South section line of said Section 20. The center of Pit No. 3 is <br />located approximately 700 feet East of the West section line and 2100 feet <br />North of the South section line of said Section 20. <br />iv. Source: Groundwater tributary to the Colorado River. <br />V. Appropriation Date: December 21, 1990. <br />vi. Amount: 167.51 acre feet per year. A portion of this amount (71.03 acre feet) <br />was made absolute in Case No. 99CW57. The remaining amount (96.48 acre <br />feet) is conditional. <br />vii. Use: Dewatering of pit during mining, evaporation, dust suppression, <br />product preparation in a batch plant, and losses through aggregate removal <br />and processing, all in connection with the mining of sand, gravel, and related <br />products, and with the reclamation of the land during and after completion of <br />such mining. <br />viii. Well Permit: The original well permit for the Arcuby Pit was issued on <br />January 7, 1993, Well Permit No. 041946-F. This original well permit was <br />replaced by a new well permit issued on February 27, 2002, to cover <br />
