Pineda <br />Director <br />I am writing to you regarding your concerns with the Wildcat permit application M-1981-185 <br />conversion to a 112d Operation (CN-01),.,, <br />Operators are required to post application materials with the County Clerk in the county court <br />house. The Division does not have authority over records management at the county level. This <br />process is handled differently by every county. The problems you experienced with the documents <br />is unfortunate and Wally Erickson's communication to you was only for clarification not accusation. <br />When Wally received your complaint letter on January 26th, as well as the letters from other nearby <br />residents, he did go on that day to the courthouse and review the documents. Given his current <br />work schedule and responsibilities, Wally's timing in responding to the written complaints is <br />extraordinary and well within our normal timeframes for responding to written complaints. <br />The Division does not have the resources or need to conduct an audit of the Wildcat Mining <br />Corporation's and Division actions since 2006. The company is now under a strict stipulation to <br />amend their current permit and come into compliance. All of the past permit documents related to <br />the Wildcat operations are available on our website. However, the company is providing new <br />information for review and our technical review is focused on the new amendment. The review is <br />extensive and will require the Division to maximize all of our resources. <br />Our goal at the Division is to get the company into compliance and that they perform the necessary <br />work to ensure environmental protection. For the state to conduct reclamation work would be a <br />burden to the Division and state resources and would only be undertaken as a last resort. We <br />currently have a mining company responsible for this site and our intention is that they perform all <br />necessary reclamation work. <br />Finally we look forward to your review and comments regarding the Wildcat permit amendment. <br />Our decision date for CN-01 will be April 11, 2011.
