Exhibit A - Legal Description <br />6.4.1 EXHIBIT A - Legal Description <br />(1) The legal description must identify the affected land, specify affected areas and <br />be adequate to field locate the property. Description shall be by (a), township, <br />range, and section , to at least the nearest quarter-quarter section and (b), <br />location of the main entrance to the site reported as latitude and longitude, or the <br />Universal Transverse Mercator (UTM) Grid as determined from a USGS <br />topographic map. A metes and bounds survey description is acceptable in lieu of <br />township, range, and section. Where available, the street address or lot <br />number(s) shall be given. This information may be available from the County <br />Assessor's Office or U.S. Geological Survey (USGS) maps. <br />(2) The main entrance to the mine site shall be located based on a USGS <br />topographic map showing latitude and longitude or Universal Transverse <br />Mercator (UTM). The operator will need to specify coordinates of latitude and <br />longitude in degrees, minutes and seconds or in decimal degrees to an accuracy <br />of at least five (5) decimal places (e.g., latitude 37.12345 N, longitude 104.45678 <br />W). For UTM, the operator will need to specify North American Datum (NAD) <br />1927, NAD1983, or WGS 84, and the applicable zone, measured in meters. <br />The 120.001: acre permit area is originally <br />that part of the E/2,SW/4; and NW/4,SW/4; <br />67 West; 6th P.M.; Weld County, Colorado. <br />defined and unaltered by this submittal as <br />all in Section 31; Township 3 North; Range <br />The Weld County GIS boundary and description is used to better define the affected <br />lands for purposes of CAD measurement and related financial determinations as: A <br />parcel of land located in part of the E/2,SW/4 and NW/4,SW/4; Section 31; Township 3 <br />North; Range 67 West; 6th P.M.; Weld County, Colorado; more specifically beginning <br />from the Center of Section 31; thence: <br />2577.02 feet S0001844"E <br />1189.71 feet S89°48'34W <br />1476.19 feet N00009'19"E <br />84.00 feet N90°00'00"W <br />1241.44 feet S89020'07'1N <br />375.40 feet N01°07'541N <br />20.00 feet N89034'13"E <br />220.49 feet N0000259"E <br />20.00 feet N89°3413"E <br />224.84 feet N00002'59"E <br />82.00 feet N51 °4841 "E <br />233.94 feet N04°51'42W <br />1104.40 feet N89042'51"E <br />1315.22 feet N8904248'1N, to the point of beginning, and comprising 102.56± acres, <br />more or less. <br />Varra Companies, Inc.
