The Amendment modifies some Exhibits (indicated in
bold lettering), while leaving unchanged those Exhibits not otherwise affected by
the changes proposed in the Amendment, as summarized below:
1) A complete 112 form - Revised, updated with the required Amendment
fee. It should be noted that the August 1992 Amendment on future use
only allowed for one mark under Future Use, and that Developed Water
Resources was selected. While the underpinning Use reverts to
Agriculture, and while the Developed Water Resources may be utilized for
Agricultural Uses; further, the August 1996 Technical Revision provided
under the Backfill Permit for the return of fill and above water land areas
to Agricultural Uses; the OMLR determined that the activity posed a
`significant change to the Reclamation due to the location of the fill within
a flood plain; so to better fulfill the notification and comment duties of the
OMLR, this Amendment was requested to clarify matters of Reclamation
for the lands remaining above water surrounding the completed basins and
within the 120.0 acre permit area. Still the form only allows for one check
mark - so in this instance Agriculture has been selected as the Future
Use, but should not be found in contradiction with any Developed Water
Resource Use previously determined and approved by the OMLR.
2) Exhibit A- Revised and clarified.
3) Exhibit B - Revised - updated on USGS Quadrangle Map.
1
